Terms of Service
Effective date: June 22, 2026.
These Terms of Service (“Terms”) govern your access to and use of Tembii, operated by Jonathan Hicks (“Tembii,” “we,” “us”). By creating an account or using the service you agree to these Terms.
1. The service
Tembii lets teachers upload lesson material and generate themed educational games powered by an AI question generator. We grant you a limited, non-exclusive, non-transferable, revocable license to use the service for your own teaching activities, subject to these Terms.
2. Acceptable use
You agree not to:
- upload illegal, harmful, hateful, or sexually explicit content;
- paste student personally identifiable information (full names, photos, contact info, grades tied to an identifiable child) into lesson uploads;
- harass, threaten, or impersonate any person or institution;
- scrape, reverse engineer, or attempt to extract model weights, prompts, or other proprietary system internals;
- use the service to build a competing question-generation product.
We may suspend or terminate accounts that violate this section, with notice where practicable and immediately for serious abuse.
3. Accounts and security
You are responsible for safeguarding your login credentials and for any activity under your account. Tell us at support@tembii.com right away if you suspect unauthorized access.
4. Subscriptions, billing, and refunds
Paid plans are billed in advance, either monthly or annually, via our payment processor. You authorize us to charge your chosen payment method on each renewal until you cancel.
Our refund policy is simple and intentionally user-friendly:
- Monthly plans: within seven days of your first charge on a monthly plan you may request a pro-rated refund for unused time. After seven days, no refund is issued for the remainder of the billing period.
- Annual plans: within thirty days of your first annual charge you may request a full refund. After thirty days, no refund is issued for the remainder of the annual term.
- No refunds are issued on plan changes, renewals, or partial usage outside of the windows above.
You may cancel anytime from your account settings. Cancellation stops future renewals; it does not, on its own, refund the current period.
5. Intellectual property
Your content stays yours. As between you and Tembii, you keep whatever rights you already hold in the lesson materials and images you upload and in the questions we generate for you from them. You grant Tembii a limited, worldwide, royalty-free license to store, process, transmit, and display that content solely to provide the service to you (for example, to send your text to our AI sub-processor for question generation, to render the results in your dashboard, and to display images you attach within games you create or share).
You are responsible for what you upload. You represent and warrant that you own, or have all necessary rights and permissions to use, any material or image you upload, and that it does not infringe the intellectual-property, privacy, or other rights of anyone else. You are solely responsible for the content you upload and for any content that appears in games you choose to share. You agree to indemnify and hold Tembii harmless from any claim, loss, or expense arising out of content you upload or share. Our platform stays ours. The Tembii software, designs, game templates, themes, and brand are owned by Jonathan Hicks and are protected by copyright and trademark law.
6. AI-generated questions
Questions are generated by a large language model and may occasionally contain factual errors or unclear phrasing. Every generated question defaults to unapproved — you must review and explicitly approve questions before they enter a game. You are responsible for the classroom use of any question you approve.
7. Disclaimers
The service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that generated questions will be accurate for any specific curriculum.
8. Limitation of liability
To the fullest extent permitted by law, Tembii and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data, arising out of your use of the service. Our total liability for any claim relating to the service is limited to the amount you paid us in the twelve months preceding the event giving rise to the claim.
9. Termination
You may terminate your account at any time from the account settings page. We may terminate or suspend your account for material breach of these Terms, with reasonable notice except where immediate action is necessary to protect other users or the service. Sections 5, 7, 8, 10, and 11 survive termination.
10. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules. Disputes will be resolved in the state or federal courts located in Delaware, USA, unless otherwise required by applicable consumer-protection law.
11. Changes to these Terms
We may update these Terms from time to time. When we do, we will post the new effective date at the top of this page and, for material changes, notify you by email or an in-product notice at least 14 days before the changes take effect. Continued use of the service after the effective date constitutes acceptance of the updated Terms.
